SPONSOR: This Contest is being sponsored and administered by Timberland, a division of VF Outdoor, LLC, 200 Domain Drive, Stratham, NH 03885 (“Timberland”). Any questions, comments or complaints regarding this Contest should be directed to Timberland.
CONTEST PERIOD: This Contest begins on July 27, 2020 at 12:00am (EDT) and ends on August 16, 2020 at 11:59pm (EDT).
WHO MAY ENTER: You must be 18 years of age or older and a legal resident of the United States or the District of Columbia to enter. Employees of Timberland, its subsidiaries and affiliates, print production agencies or any other person or company connected with the production or distribution of this Contest and the immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related, of the foregoing, are not eligible to enter or to be awarded a prize. This Contest is void in Puerto Rico and where prohibited by law.
HOW TO ENTER:
Phase 1 – Entering the Contest
Entries are to be submitted by posting your photo to Facebook and/or Instagram and must include the hashtags #AlwaysDoNeverDone and #contest.
Timberland reserves the right to exclude any participant, username, profile information, image or video that it deems to be obscene, offensive or otherwise not in good taste, as determined by Timberland in its sole discretion.
Entries may not defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights.
For all entries, Timberland shall have the perpetual right to edit, adapt and publish any or all of an entry, and may use it in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. AN ENTRY CONSTITUTES ENTRANT’S AGREEMENT TO GRANT SPONSOR AND IRREVOCABLE ROYALTY-FREE WORLDWIDE LICENSE TO REPRODUCE AND DISPLAY THE ENTRY OR ANY DERIVATIVE THEREOF. Electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries that are incomplete, illegible or corrupted are void and will not be accepted. By entering the Contest, entrant recognizes and agrees that the registration information provided by entrant will be made available to Timberland; use of such information will be governed by Timberland’s privacy policy found here: https://www.timberland.com/privacy-security/privacy.html.
Phase 2 - Winner Selection: Each Monday during the Contest Period (August 3, 2020, August 10, 2020, and August 17, 2020), three (3) winning entries will be selected by qualified judges, as chosen by Timberland in its sole discretion, from all entries submitted the previous week. Entries will be judged on creativity, originality and aesthetics. Weekly winners will be awarded $400.00 of PRO Workwear and Footwear.
Odds of winning will depend on the number of eligible entries received.
WINNER NOTIFICATION AND AWARD OF PRIZE: Winners will be notified via email or social media. All winners will be notified by August 24, 2020. The prizes will only be awarded by Timberland upon verification of potential winners and final approval by Timberland. The potential winners will receive notification that they have won and will have forty eight (48) hours from receipt of winning notification to confirm that the notification has been received. If a potential winner of a prize cannot be contacted; is ineligible; fails to claim the prize; if the prize notification is returned undeliverable; or if a potential winner otherwise fails to fully comply with these official rules, he/she will forfeit that prize and the prize may be awarded to an alternate potential winner.
PRIZES AND APPROXIMATE RETAIL VALUE:
Nine (9) winners will each receive $400.00 of Timberland PRO Workwear and Footwear, Total ARV $3600.00.
LIMITATION OF LIABILITY: By entering this Contest or accepting a prize, all entrants agree to release, discharge, and hold harmless Timberland and its affiliates and subsidiaries, employees, officers, directors, agents and representatives from any and all liability, claims, losses and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder, including, without limitation, all liability for injuries, including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death or disability), property damage, or loss or damage of any other kind arising in whole or in part, directly or indirectly, from delivery/non-delivery, acceptance, use or misuse of the prize or from participation in this Contest or any Contest--related activity.
INTERNET: Timberland is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alternation of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Timberland on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If, for any reason, the Internet portion of the programs is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Timberland reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Timberland reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Timberland reserves the right to seek damages from any such person to the fullest extent of the law.
CONDITIONS OF PARTICIPATION: This Contest is void where prohibited. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Timberland, shall be subject to and governed by the laws of the State of New Hampshire, without regard to conflicts of law. All suits or claims brought in connection with this Contest must be brought in a state or federal court in New Hampshire. No transfer, assignment or substitution of a prize, except Timberland reserves the right to substitute the prize (or a portion thereof) for an item of equal or greater value in the event a prize (or portion thereof) is unavailable. All federal, state, local and provincial laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Timberland, which are final and binding on all matters pertaining to this Contest. Acceptance of the prize constitutes permission for Timberland and its affiliates and agencies to use, anywhere in the world, winner’s name, photo and/or likeness, voice and biographical information, for any use, including, without limitation, advertising and Contestal purposes without additional compensation, unless prohibited by law. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
CHOICE OF LAW AND JURISDICTION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, winners and Timberland shall be governed by, and construed in accordance with, the laws of the State of New Hampshire, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Hampshire or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of New Hampshire). Any action seeking legal or equitable relief arising out of or relating to the Contest or these Official Rules shall be brought only in the courts of the State of New Hampshire.
WINNERS LIST: For winners’ names, send a separate self-addressed, stamped envelope (if state law prohibits, postage need not be prepaid) to: Timberland, a division of VF Outdoor, LLC., Attention: Ryan Murphy, 200 Domain Drive, Stratham, NH 03885. All requests must be received by December 31, 2020.
DATA PRIVACY: Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules or Timberland’s Privacy Policy (https://www.timberland.com/privacy-security/privacy.html).
